When you have signed up with a coach, who uses the Lenus Platform and App to provide you with the coaching services, your coach and Lenus eHealth ApS (‘Lenus’) will act as joint data controllers for the processing of your personal data on the Lenus Platform.
In Lenus we strive to create a better world for health coaching - and we take the responsibilities seriously. Also regarding the responsibilities we have when data is processed on our Platform. This responsibility is a shared responsibility between your coach and Lenus.
We take on the responsibility of joint controllership as your coach and Lenus depend on each other to reach the purposes for the processing of personal data.
- Lenus is depending on a coach being involved, while the coach is depending on Lenus, as the Lenus Platform sets out the foundation for the coach’s ability to deliver online coaching services.
- The Lenus Platform defines the boundaries of what services can be provided by your coach. However, your coach solely defines how the services are to be delivered within this scope and to assess the quality and character of these services.
- The Parties are financially motivated to reach the joint purposes and goals in collaboration.
Below is some information on how this split of data responsibilities are made:
- Your coach is solely responsible for the contract and the content to be provided to you as a client. As such, your main contact will be your coach, who will also ongoingly collect personal data in your relationship. Your coach may also collect personal data outside of the Lenus platform and the website of the coach, in which case they will act as independent data controllers.
- Lenus on the other hand, is responsible for:
- Choosing and setting up the data processors processing personal data for the performance of the platform, including the risk assessment and supervision of these.
- Defining the security settings of the platform, encryption, deletion of data, privacy by design in the platform development and access management. In this regard, please be aware that the coach is responsible for safeguarding how the system is accessed, and Lenus is not responsible for the creation and use of strong passwords, insecure password sharing, or the use of accounts against the Lenus terms and policies hereon.
- The management of your data subject rights through our Support channel. You can read more about your rights here.
- Choosing and setting up the data processors processing personal data for the performance of the platform, including the risk assessment and supervision of these.
Both your coach and Lenus is responsible for providing you with the relevant information on the processing activities taking place in accordance with Articles 13 and 14 of the GDPR, and ensuring that processing of personal data is done based on a legal basis, cf. Art. 6 and 9 of the GDPR. If you want more information on how your coach is processing your personal data, please consult the privacy policy on your coach’s website.
